These General Conditions of Sale govern the sale of .KATE LEE items on the site by:

Paris New York, a limited liability company with capital of 100,000 euros, located in Paris 75003 – 16, rue des Gravilliers, registered in the trade and companies register under number 383 949 997 PARIS. Intra-community VAT number: FR 29 383 949 997.
Placing an order implies full acceptance of these General Terms and Conditions of Sale, which are accessible at any time on the site and in particular when the order is registered. We invite you to print and keep a copy of these General Conditions of Sale for future reference. Unless proven otherwise, the data recorded by us constitutes proof of the transactions and their date.
The General Conditions of Sale constitute the only agreement between the parties and prevail over any other document. They can be changed at any time. The new General Terms and Conditions of Sale will apply to any order after they are made available on the site.

1. Object

The purpose of these General Conditions of Sale is to define the conditions under which the Products are marketed by the company .Kate Lee Paris New York to the Customer. They thus regulate the different stages of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.

2. Acceptance of the General Conditions

The Customer must carefully read the General Conditions and accept them, before proceeding to the payment of an order of Products placed on the Site. The General Conditions are referenced at the bottom of each page by means of a link and must be consulted before clicking on the first "Order" button to place the order. The Customer is invited to read carefully, print the General Conditions and keep a copy.
.Kate Lee Paris New York advises the Customer to read the General Conditions with each new order, the latest version of the said Conditions applying to any new order of Products.
By clicking on the first “Order” button to place the order and then on the second to confirm said order, the Customer acknowledges having read, understood and accepted the General Conditions without limitation or condition.

3. Products

The Products offered for sale by .Kate Lee Paris New York are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the sizes and colors available, the composition, as well as the particular characteristics. Differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. If errors appear, the responsibility of .Kate Lee Paris New York cannot be engaged.

4. Price

The prices are indicated in euros all taxes included, excluding delivery costs; it being specified that the value added tax is that in force on metropolitan French territory on the day of validation of the order.
The prices applied are those communicated on the Site and confirmed to the Customer during the validation of the order.
The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed all taxes included. These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products.
Prices are subject to change at any time, it being understood that the items are invoiced on the basis in force when the order is registered.
The transfer of the risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.

5. Ordering and payment of Products

• 5.1 Ordering
To be able to purchase a Product, the Customer must be at least 18 years old and have legal capacity.
Orders will be received and will be accepted within the limits of available stocks.
Customers may also contact Paris New York at any time by e-mail, at the address contact@katelee.fr , in order to obtain information on the status of their order.
If, despite the vigilance of .Kate Lee Paris New York, the items ordered are no longer available, .Kate Lee Paris New York will inform the customer by e-mail or by telephone as soon as possible by offering him a similar product on where applicable or will refund the price by crediting the customer's bank account.
In accordance with the law of March 13, 2000 on electronic signature, any purchase order signed by the customer by "double click" constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in these general conditions of sale as “right of withdrawal” and “out of stock”.
The "double click" associated with the authentication and non-repudiation procedure and the protection of all messages constitutes an electronic signature. This electronic signature has value between the parties as a handwritten signature.
The information that the Customer provides to Paris New York when opening a customer account or when placing an order must be complete, accurate and up-to-date. .Kate Lee Paris New York cannot be held responsible for any input errors and the consequences in terms of delays or delivery errors. In this context, all costs incurred for reshipment will be borne by the customer.

• 5.2 Payment
The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer. Payment is made online by PayPal at the time of validation of the order by the Customer.
The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. .Kate Lee Paris New York reserves the right to proceed with a new request for direct debit authorization in the event that the first could not be completed due to the unavailability of the servers.
In the event of a payment default, an incorrect address or any other problem on the Customer's account, .Kate Lee Paris New York reserves the right to block the Customer's order until the problem is resolved.
.Kate Lee Paris New York remains the owner of the Products delivered until full payment by the Customer.

6. Delivery

Orders will be delivered accompanied by a delivery slip within a maximum of ten (10) working days.
The items offered for sale will only be delivered in Metropolitan France, including Corsica and in the countries offered on the site. You will be delivered to the address indicated when ordering.

Any order placed on the Site from Monday to Friday before 12 noon will be processed the same day; after 12 noon, it will be processed the following day. Any order placed on Friday after 12 noon, on Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the following working day.
In the event of exceeding the delivery time, not justified by a case of force majeure, the Customer may request the resolution of the sale and obtain within a maximum period of 30 (thirty) days the reimbursement of the sums paid on the occasion of the sale.

7. Receipt of the order - Complaints - Returns

The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery (damaged package, damaged products, products not conforming to the order) must be notified within the legal deadlines following receipt of the order.
This notification will be sent to the customer service of the .Kate Lee site either:

After this period, and except for hidden defects, no complaint will be accepted by .Kate Lee Paris New York, the Products then being deemed to be compliant.
In the case of a shipment made by post, if the package arrives open or damaged (in particular with the presence of yellow "La Poste" tape) it is essential that the customer have the postman or the post office from which he depends on a “report of spoliation” (report 170) so that .Kate Lee Paris New York can open an investigation and a compensation procedure.
At the same time, the customer must confirm this anomaly by sending the carrier within two (2) working days following the delivery date, a registered letter with acknowledgment of receipt setting out the said complaints.
The customer must simultaneously send a copy of this letter (with the original of the "spoliation report" if applicable) by simple mail to: .Kate Lee Service Retour 16 rue des Gravilliers 75003 Paris. Any complaint received after the deadline will be rejected.
For any return of non-compliant Product, the Customer must comply with the following procedure:

  • the customer must notify the company .Kate Lee Paris New York by sending an electronic message to our E-shopping Customer Service: relationclient@katelee.fr .

  • the Customer must attach the invoice to his package. No return can be accepted without said invoice.

  • the Products must be returned either in their original packaging, or in packaging protecting the product against any deterioration, with their label and any accessories allowing them to be marketed again, to the following address: KATE LEE Paris NY - SERVICE SAV, 16 rue des Gravilliers, 75003 Paris

  • The risks associated with the return are the sole responsibility of the Customer.

  • Free return on request by email to: relationclient@katelee.fr .

When non-compliance has been noted, .Kate Lee Paris New York will offer the Client either:

  • the replacement of the Product(s), either,

  • reimbursement of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product, at the latest within thirty (30) days from the date of sending the notification of confirmation of non-compliance by the customer service of the .Kate Lee site.

In the event of a refund, .Kate Lee will reimburse all products rendered compliant, as well as the shipping costs incurred.
Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, .Kate Lee pays for the reimbursement of return postage costs up to the price list (Colissimo delivery without registered) displayed by La Poste on March 1 of the current year . The Customer must send proof of the return costs incurred to Customer Service, by email or by post.
In the event of abnormal or abusive complaints, .Kate Lee Paris New York may refuse to serve a subsequent order.

8. Right of withdrawal

The Customer has a period of fourteen (14) working days from the date of receipt of his order to return the Products ordered, without justification or penalty.
For any return under the right of withdrawal, the procedure below must be fully respected:

  • the Customer must attach the invoice to his package. No return can be accepted without said invoice.

  • the Products must be returned in their original packaging, with their label and any accessories, in perfect condition to: .Kate Lee Service Retour, 16 rue des Gravilliers, 75003 Paris - France

.Kate Lee recommends that the customer return their products by tracked colissimo, provided with a recommendation or additional insurance guaranteeing them, where applicable, compensation for the products up to their actual market value in the event of spoliation or loss of this merchandise.

  • the risks of return are the sole responsibility of the Customer.

  • Free return on request by email to: relationclient@katelee.fr .

Subject to the conditions mentioned above, .Kate Lee Paris New York will reimburse the amount including VAT of the order to the Customer (price of the product) excluding delivery costs and shipping costs. The Customer's bank account will be credited with said amount, within thirty (30) days of receipt of the Products by .Kate Lee Paris New York.

9. Kate Lee Warranty

The items offered comply with the regulations in force. They benefit from the know-how and quality of .Kate Lee Paris New York.
Thus they are guaranteed against any manufacturing defect. If such a defect occurs, .Kate Lee Paris New York undertakes to repair your purchase free of charge, or to exchange it. In case of exchange, defective items will not be returned.
The .Kate Lee warranty of course does not cover normal wear and tear, nor accidental damage, nor that caused by the use of a solvent or by abnormal use of the article.
As part of the implementation of the .Kate Lee guarantee, we invite you to contact our E-Shopping Customer Service upon receipt of the bag: sav@katelee.fr . This, after verification, will tell you how to return your item(s).

10. After-Sales Service

The .Kate Lee After-Sales Service is responsible for carrying out repairs to wear and tear on your items, as well as repairs occurring within the framework of the implementation of the Legal Guarantees and the .Kate Lee Guarantee.
To contact our After-Sales Service, we invite you to contact us preferably by e-mail: sav@katelee.fr .
Your item will be sent to our workshops, which will take the appropriate decision: In the event of a manufacturing defect noted and validated by our workshops, we will repair your item free of charge or replace it with a new item of equivalent value.
For used items, the repair will be chargeable. You will be offered an estimate if the damage observed is the result of your own fault or that of a third party.
Your item will not be repaired if it is excessively used. It will then be returned to you as is.
.Kate Lee's after-sales service only concerns sales made on the e-store www.katelee.fr . For items purchased in store, please contact your .Kate Lee retailer.

11. Personal Data

.Kate Lee Paris New York collects a certain amount of information necessary to process orders.
This data is not only necessary for the processing of the Customer's order by .Kate Lee Paris New York, but also to communicate to the Customer information on the .Kate Lee brand, on the Site or to allow him to benefit from .Kate Lee commercial offers. if the Customer accepts it by validating his order.
The Customer can also modify his personal details from his customer area by identifying himself using his email address and password.

12.Cookies

14. Force Majeure

In such a case, .Kate Lee Paris New York will inform the Customer of the occurrence of such an event within 5 (five) clear days following its occurrence, by e-mail.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will, if necessary, be reimbursed by .Kate Lee Paris New York on the credit card used to place the order within a maximum of 30 (thirty) days.

15. Liability and Applicable Law

The .Kate LeeParis New York company cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The same is true for any changes to the products resulting from the suppliers.
The responsibility of the company .Kate Lee Paris New York will, in any case, be limited to the amount of the order and cannot be blamed for simple errors or omissions which could have remained despite all the precautions taken in the presentation. some products.
The company .Kate Lee Paris New York cannot be held responsible, towards a customer or a third party, for any indirect damage, any operating loss, profit or turnover, occurring in any way whatsoever. either, even if this damage or this loss or this injury was foreseeable by the company .Kate Lee Paris New York, or if its possibility had been brought to its attention.

If any of the terms of these General Terms and Conditions of Sale were found to be null, illegal or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale will remain in force.
The General Conditions of Sale are executed and interpreted in accordance with French law.
In the event of a dispute, the customer should first contact .Kate Lee Paris New York to obtain an amicable solution and in the absence of an agreement, the Courts of common law will have sole jurisdiction.
