We invite you to print and keep a copy of these General Sales Conditions for future reference. Unless proven otherwise, the data recorded by us constitute proof of transactions and their date. The General Sales Conditions constitute the sole agreement between the parties and prevail over any other document. They may be modified at any time. The new General Sales Conditions will apply to any order placed after they are made available on the website.

  1. Object

These General Sales Conditions aim to define the conditions under which the Products are marketed by the company .Kate Lee Paris New York to the Client. They thus regulate the various stages of the sale process: from the placing of the order by the Client to the delivery of the Product to the Client.

  1. Acceptance of the General Conditions

The Client must carefully read the General Conditions and accept them before proceeding with the payment of an order for Products placed on the Site. The General Conditions are referenced at the bottom of each page by means of a link and must be consulted before clicking on the first "Order" button to place the order. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the available sizes and colors, the composition, as well as the specific characteristics. Differences between a product and its photograph may exist, depending in particular on the resolution and definition of the user's screen colors. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual.   1. Prices

Prices are indicated in euros including all taxes, excluding delivery charges; it being specified that the value added tax is that in force in metropolitan France on the day of validation of the order. The prices applied are those communicated on the Site and confirmed to the Client when validating the order. Delivery charges are communicated to the Client on the order summary before validation of the latter and are expressed all taxes included. These charges are borne by the Client and are invoiced in addition to the selling price of the Products. The transfer of risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Client.

  1. Order and payment of Products
  • 5.1 Ordering In order to purchase a Product, the Client must be at least 18 years old and have legal capacity. Orders will be received and accepted within the limits of available stocks. If despite the vigilance of .Kate Lee Paris New York, the ordered items are no longer available, .Kate Lee Paris New York will inform the client by email or by phone as soon as possible, offering a similar product if applicable or refunding the price by credit to the client's bank account. In accordance with the law of March 13, 2000 on electronic signatures, any purchase order signed by the client by "double click" constitutes an irrevocable acceptance which can only be called into question in the cases limitatively provided for in these general conditions of sale such as "right of withdrawal" and "out of stock". The "double click" associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature. This electronic signature has value between the parties as a handwritten signature. The information that the Client provides to .Kate Lee Paris New York when opening a customer account or when placing an order must be complete, accurate and up to date. .Kate Lee Paris New York cannot be held responsible for any typing errors and the consequences in terms of delays or delivery errors. In this context, all costs incurred for reshipment will be borne by the customer.
  • 5.2 Payment The price of the Products purchased is payable in full, on the day of placing the order by the Client. Payment is made online at the time of order validation by the Client. The request for authorization to debit the payment card is made at the time of order validation on the Site, except in case of server unavailability. .Kate Lee Paris New York reserves the right to make a new authorization request for payment in the event that the first request could not be completed due to server unavailability. In the event of a payment default, an incorrect address or any other problem with the Client's account, .Kate Lee Paris New York reserves the right to block the Client's order until the problem is resolved. .Kate Lee Paris New York remains the owner of the Products delivered until their full payment by the Client.
  1. Delivery

The items offered for sale will be delivered in Metropolitan France, including Corsica and the countries offered on the site. You will be delivered to the address indicated when ordering.

Any order registered on the Site from Monday to Friday before 12 p.m. will be processed the same day; after 12 p.m., it will be processed the next day. Any order placed on Friday after 12 p.m., Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the following working day. In the event of a delivery delay, not justified by a case of force majeure, the Client may request the resolution of the sale and obtain reimbursement of the sums paid on the occasion of the sale within a maximum period of 30 (thirty) days.

  1. Receipt of the order - Complaints - Returns

The Client is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery (damaged package, deteriorated products, products not conforming to the order) must be notified within the legal deadlines following receipt of the order. This notification will be transmitted to the customer service of the .Kate Lee site either:

After this period, and except for hidden defects, no complaint will be accepted by .Kate Lee Paris New York, the Products being then deemed to be compliant. In the case of a shipment by La Poste, if the package arrives open or damaged (in particular with the presence of the Yellow "La Poste" tape), it is essential that the customer obtains a "spoliation report" (report 170) from the postman or the Post Office to which he belongs so that .Kate Lee Paris New York can open an investigation and compensation procedure. The customer must also confirm this anomaly by sending to the carrier within two (2) working days following the delivery date a registered letter with acknowledgment of receipt stating the said complaints. Any complaint received out of time will be rejected. For any return of non-compliant Product, the Client must follow the following procedure:

The Client must include the invoice with his package. No return will be accepted without said invoice.

The risks related to the return are borne exclusively by the Client.

Return costs are borne by the customer. A request must be made in advance on the Site.

When the non-compliance has been established, .Kate Lee Paris New York will offer the Client either:

the replacement of the Product(s), or,

the refund of the order price (Product prices and delivery costs), no later than thirty (30) days from the date of sending the notification of confirmation of non-compliance by the .Kate Lee website customer service.

In case of refund, .Kate Lee will refund the entire amount of the products returned compliant.

Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, .Kate Lee covers the refund of postal return costs up to the rate schedule (Colissimo delivery without recommendation) displayed by La Poste on March 1 of the current year. The Customer must provide proof of the return costs incurred to the Customer Service, by email or by mail. In case of abnormal or abusive claims, .Kate Lee Paris New York may refuse to serve a subsequent order.

  1. Right of withdrawal

The Client has a period of fourteen (14) working days from the date of receipt of his order to return the Products ordered. For any return under the withdrawal right, the following procedure must be fully respected:

The Client must include the invoice with his package. No return will be accepted without said invoice.

.Kate Lee recommends that the customer return their products by registered Colissimo, with a recommendation or additional insurance guaranteeing, if necessary, compensation for the products up to their real market value in case of spoliation or loss of this merchandise.

The risks of return are borne exclusively by the Client.

Return costs are borne by the customer.

Subject to the above conditions, .Kate Lee Paris New York will refund the VAT amount of the order to the Client (product price) excluding delivery and shipping costs. The Client's bank account will be credited with said amount, within thirty (30) days from the receipt of the Products by .Kate Lee Paris New York.

  1. .Kate Lee Warranty

The items offered comply with current regulations. They benefit from the know-how and quality of .Kate Lee Paris New York. Thus they are guaranteed against any manufacturing defect. If such a defect were to occur, .Kate Lee Paris New York undertakes to repair your purchase free of charge, or to exchange it. In the event of an exchange, the defective items will not be returned. The .Kate Lee warranty does not cover normal wear and tear, accidental damage, or damage caused by the use of a solvent or by abnormal use of the item. As part of the implementation of the .Kate Lee warranty, we invite you to contact our E-Shopping Customer Service as soon as you receive the bag: sav@katelee.fr. After verification, they will inform you of the return procedures for your item(s).

  1. After-Sales Service

The .Kate Lee After-Sales Service is responsible for carrying out wear repairs on your items, as well as repairs carried out as part of the implementation of Legal Guarantees and the .Kate Lee Guarantee. To contact our After-Sales Service, we invite you to contact us preferably by email: sav@katelee.fr. Your item will be sent to our workshops which will make the appropriate decision: In the event of a manufacturing defect observed and validated by our workshops, we repair your item free of charge or replace it with a new item of equivalent value. For used items, the repair will be chargeable. A quote will be provided if the damage observed results from your own actions or those of a third party. Your item will not be repaired if it is too worn. It will then be returned to you as is. The after-sales service of .Kate Lee only concerns sales made on the www.katelee.fr e-shop. For items purchased in-store, please contact your .Kate Lee retailer.

  1. Personal Data

.Kate Lee Paris New York collects a certain amount of information necessary for order processing. This data is not only necessary for the processing of the Client's order by .Kate Lee Paris New York, but also to communicate information about the .Kate Lee brand, the Site or to provide the Client with .Kate Lee commercial offers if the Client accepts it by validating his order. The Client can also modify his personal information from his customer area by identifying himself using his email address and password.   1. Cookies

In such a hypothesis, .Kate Lee Paris New York will inform the Client of the occurrence of such an event within a period of 5 (five) clear days following its occurrence, by email. After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, if applicable, .Kate Lee Paris New York will refund it to the credit card used to place the order within a maximum period of 30 (thirty) days.

  1. Liability and Applicable Law

The company .Kate Lee Paris New York cannot be held responsible for any damages of any kind, whether material, immaterial or bodily, resulting from a malfunction or improper use of the products marketed. The same applies to any modifications to the products resulting from suppliers. The liability of .Kate Lee Paris New York will in any event be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. The company .Kate Lee Paris New York cannot be held liable, to a customer or a third party, for any indirect damage, operating loss, loss of profit, loss of chance, damage or expenses, which may arise from the purchase of any product presented on the site. All clauses contained in the General Sales Conditions, as well as all the purchase and sale transactions referred to herein, will be subject to French law.

  1. Disputes

Any dispute relating to the interpretation, execution or termination of the contract concluded between .Kate Lee Paris New York and the Client, even in the event of multiple defendants, will be, in the absence of an amicable agreement, the exclusive jurisdiction of the French courts, and this, even in the event of a warranty claim or multiple defendants.

  1. Intellectual Property

All the elements of the Site are and remain the intellectual and exclusive property of .Kate Lee Paris New York. No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements of the Site, whether in the form of software, visuals or sound.
